Second Shooter & Associate Shooter Contract

1. Overview
This is an Agreement between Parties: Stephanie Dreams Photography The “Primary”, and an independent contractor who is referred to subsequently as The “Second”. This agreement becomes effective when this link is sent to the second

2. Position

The second agrees to work for the primary as a work-for-hire independent contractor providing wedding photography related services on an agreed basis. The second is a freelancer working for themselves.

3. Assignment

 This assignment, as well as any future assignments, is and will be contracted on a case-by-case basis only. All work performed by the second for the primary shall be governed by the covenants of this agreement. The specifics of each job and agreement would have been confirmed through email or Instagram messaging.

4. Independent Contractor

 The second and the primary specifically agree that the second is performing the services as an independent contractor and is not an employee of the primary. Nothing in this agreement shall be construed as creating an employer-employee relationship. The second further agrees to be responsible for all of their own insurance, software & equipment they may need to complete the job.

5. Compensation

The second shall be paid the amount agreed upon successful transfer of all photos to the primary. Rate and hours to be agreed in prior to the event. An invoice must be sent before the day of the job to steph@stephaniedreamsphotography.com so payment can be made smoothly.

6.1 Delivery of images (associate shooters only)

The second agrees to transfer 20-30 “preview images” they took at the event within 12 hours of completion of the event, through we transfer (or similar). The second agrees to then send the full set of SD cards from the job to the primary within 48 hours of the job, and will not delete back up cards/RAW images until primary has confirmed the receipt of these.

6.2 Delivery of images (second shooters only)

The second will be given SD cards for slot 1 of their cameras by the primary, either on the day of the wedding or sent before the wedding depending on timeline. At the end of the day the second will give these cards to the primary, and will not delete back up cards/RAW images until the primary has confirmed all images are backed up and safe.

7. Copyright & Reproduction Rights

 The second’s assignment is work for hire. As such, the copyrights of the images produced by them belong to the primary. Second agrees not to sell any image taken during the contracted event to any person, company, group, advertising agency, or otherwise. The primary grants second permission to use the images taken during the contracted event for their professional use once the completed gallery has been delivered to the couple. The only exclusion to this is if a blog or magazine would like exclusivity of the images in this case the primary will notify the second as soon as possible and inform them when they can thus feature the images. Any web use shall include an accompanying credit, such as “Photographed for Stephanie Dreams Photography”/ “Second shot for Stephanie Dreams Photography” any time the image is shared, with a link to the website stephaniedreamsphotography.com. Any social media use shall also include credit within the caption such as “Photographed for Stephanie Dreams Photography”/”Second shot for Stephanie Dreams Photography” using @stephaniedreamsphotography however no location, supplier or couple should be named or tagged in these. Any photos shared by the second can only be those that have been shared to the client by the primary in the final gallery.

 8. Exclusivity

The second understands that they represent Stephanie Dreams Photography and not any other business while completing assignments for the primary. While directly working for the primary, the second will not advertise their own business, will not solicit work for themselves, and will only distribute the primary’s business cards, name, and marketing materials.

9. Liability

The second warrants that they are liable for any loss or any other financial liability suffered by the primary, due to a failure to perform, other than a documented medical emergency or an “Act of God”. The primary is not liable for any loss or damage to the second’s equipment under this contract.

10. Equipment

The second is responsible for providing all of their own equipment with which to complete the assignment and is expected to have the correct equipment for taking on the job. This includes but is not inclusive to, a professional camera with backup body, lens/es to cover candid’s & different angles to primary.

11. Description of services

 For each event, the second shall:

  • Arrive no later than fifteen minutes prior to the start time stated by the client.

  • Provide their own equipment and supplies.

  • Capture images for the scheduled duration of the event as specified by the primary.

  • Deliver the RAW images to the primary following the end of the event.

  • Capture high-quality images in a professional manner in keeping with industry standards.

  • Take responsibility of them self & do what is needed as a competent second.

Should the second perform the photography services on the day of the event but fail to deliver the images for any reason (including, but not limited to, the loss of digital files or other media or the failure of the seconds equipment), or should the images be of a poor quality not within professional standards, such failure to deliver the images or perform the services, shall constitute a material breach of the terms of this agreement. This will thus subject the second to monetary damages as a result of the breach, including but not limited to, full or partial waiver of seconds fee for that event, in addition to reimbursement to the primary of any sums the primary must refund to the client(s) as a result of seconds acts or omissions and/or the costs incurred by the primary to remedy the situation.

For Film Photography Only
The Primary will supply film stock to the second, and get used film stock back at the end of the day. The primary will cover all developing costs. All negatives belong to the primary. All scans from the second can be sent to them only if they make note of what has been shot be them (such as stock, start & end image etc).
If the second is covering associate shooting then the film stock will be delivered to them prior to the day, film will be sent back to the primary or sent to developing from the second with costs covered by the primary, with scans be directly sent to the primary.

For Content Phone Videos Only
All RAW/non edited clips will be sent via airdrop (or similar) to the primary at the end of the day. The second can use these as individual clips on their own for marketing however they must not put a vlog/content video together similar to what would be delivered to the client.

This agreement constitutes the entire agreements between the parties.
